width=\u00bb1\/1&#8243; tablet_width_inherit=\u00bbdefault\u00bb animation_type=\u00bbdefault\u00bb bg_image_animation=\u00bbnone\u00bb border_type=\u00bbsimple\u00bb column_border_width=\u00bbnone\u00bb column_border_style=\u00bbsolid\u00bb][vc_column_text]A continuaci\u00f3n, se describen los t\u00e9rminos y condiciones que rigen el uso del App NetUno Voz (el \u201cApp\u201d) para el servicio de telefon\u00eda fija, prestado por VENINFOTEL COMUNICACIONES VITCOM, C.A. y comercializado a los clientes de NETUNO, C.A. en adelante los CLIENTES:[\/vc_column_text][vc_column_text]NETUNO, C.A., en lo adelante NETUNO, es una sociedad mercantil domiciliada en Caracas, constituida inicialmente como CABLE CORP TV, C.A., conforme a documento inscrito en el Registro Mercantil Primero de la Circunscripci\u00f3n Judicial del Distrito Federal y Estado Miranda, el 17 de mayo de 1993, bajo el N\u2070 63, Tomo 75-A-Pro., cuya modificaci\u00f3n de su denominaci\u00f3n social fue aprobada en Acta de Asamblea General Extraordinaria de Accionistas celebrada en fecha cuatro (04) de febrero de 2002, inscrita por ante la misma oficina de Registro Mercantil en fecha dieciocho (18) de febrero de 2002, bajo el N\u2070 44, Tomo 18-A-Pro.; teniendo una modificaci\u00f3n \u00edntegra de sus estatutos tal como se evidencia en Acta de Asamblea General Extraordinaria de Accionistas de fecha tres (03) de agosto de dos mil quince (2015), inscrita en el mismo Registro Mercantil en fecha veintiuno (21) de septiembre de dos mil quince (2015) bajo el N\u2070 19 del Tomo 152-A-Pro., identificada con el Registro de Informaci\u00f3n Fiscal N\u2070 J-30108335-0 y debidamente habilitada para la prestaci\u00f3n de servicios de telecomunicaciones, seg\u00fan consta en Habilitaci\u00f3n General N\u2070 HGTS-03280 otorgada por la Comisi\u00f3n Nacional de Telecomunicaciones (CONATEL) el 11 de marzo de 2003 y renovada por dicha Comisi\u00f3n el 25 de junio de 2018; quien comercializa y factura el servicio de telefon\u00eda por cuenta y nombre de VENINFOTEL COMUNICACIONES (VITCOM), C.A., sociedad mercantil domiciliada en Caracas y debidamente inscrita ante el Registro Mercantil V de la Circunscripci\u00f3n Judicial del Distrito Federal y Estado Miranda, el d\u00eda 27 de septiembre de 2000, bajo el N\u2070 6, Tomo 462AQTO, RIF J-30741095-7, debidamente habilitada para la prestaci\u00f3n de servicios de telefon\u00eda fija local, telefon\u00eda de larga distancia nacional y telefon\u00eda de larga distancia internacional, seg\u00fan se desprende de la Habilitaci\u00f3n General N\u2070 HGTS-00022, de fecha 21 de febrero de 2001, otorgada por CONATEL, y renovada por dicha Comisi\u00f3n el 10 de febrero de 2026.<\/p>\n<div class=\"btn-bubble-icon\"><\/div>\n[\/vc_column_text][\/vc_column_inner][\/vc_row_inner][\/vc_column][\/vc_row][vc_row type=\u00bbin_container\u00bb full_screen_row_position=\u00bbmiddle\u00bb column_margin=\u00bbdefault\u00bb column_direction=\u00bbdefault\u00bb column_direction_tablet=\u00bbdefault\u00bb column_direction_phone=\u00bbdefault\u00bb scene_position=\u00bbcenter\u00bb text_color=\u00bbdark\u00bb text_align=\u00bbleft\u00bb row_border_radius=\u00bbnone\u00bb row_border_radius_applies=\u00bbbg\u00bb overflow=\u00bbvisible\u00bb overlay_strength=\u00bb0.3&#8243; Para ello, NETUNO implementar\u00e1 mecanismos de<\/p>\n<p>NETUNO ofrece a sus CLIENTES una extensi\u00f3n del servicio de telefon\u00eda fija prestado por VITCOM que podr\u00e1n disfrutar en un tel\u00e9fono inteligente, bajo estrictos est\u00e1ndares de seguridad, confidencialidad y privacidad. Para ello, NETUNO implementar\u00e1 mecanismos de verificaci\u00f3n a los fines de resguardar los datos y actividades de estos. Dichos mecanismos comprenden niveles de seguridad que tienen como objetivo evitar fraudes y proteger a los CLIENTES, quedando la custodia y el buen uso de las mismas bajo exclusiva responsabilidad de los CLIENTES y, de ser el caso, de las consecuencias de su divulgaci\u00f3n o de su utilizaci\u00f3n por terceros. Por tal motivo, NETUNO se compromete a no emitir o divulgar datos personales sin el expreso consentimiento de sus CLIENTES salvo que se le sean requeridos por los organismos gubernamentales competentes y facultados para ello por la legislaci\u00f3n nacional vigente.[\/vc_column_text][vc_column_text]Todo el contenido, software, interfaces de usuario, textos, gr\u00e1ficos, logotipos, dise\u00f1os, fotograf\u00edas, iconos de botones, im\u00e1genes, compilaciones de datos y software que se incluyen en el App y\/o que se entregan a los usuarios como parte del servicio, son bienes de NETUNO, sus licenciantes y\/o proveedores, y est\u00e1n protegidos por leyes y normativas que rigen los derechos de autor, marcas, o de propiedad intelectual de otro tipo.[\/vc_column_text][vc_column_text]Queda expresamente entendido que entre NETUNO y los CLIENTES, que las bases de datos digitales, originales o no, que han sido creadas con ocasi\u00f3n de brindar productos y servicios con data e informaci\u00f3n personal, privada y confidencial de los CLIENTES, le pertenecen a NETUNO quien es el \u00fanico titular de los derechos econ\u00f3micos sobre las mismas. No obstante, NETUNO proteger\u00e1 y respetar\u00e1 los derechos de intimidad, honor y reputaci\u00f3n de las personas, establecidos en la Constituci\u00f3n de la Rep\u00fablica Bolivariana de Venezuela.[\/vc_column_text][vc_column_text]Los CLIENTES, de conformidad con las Condiciones Generales y T\u00e9rminos de Uso y Privacidad de la App, deben manifestar expresamente, por los diversos mecanismos de comunicaci\u00f3n establecidos al efecto, a NETUNO, si no desean recibir mensajes informativos y\/o comerciales a trav\u00e9s del App, en cuyo caso, NETUNO, en un plazo no mayor de veinticuatro (24) horas, deber\u00e1 cesar en dichos env\u00edos y aplicar las medidas correctivas correspondientes. No obstante, NETUNO se reserva el derecho de suspender el acceso a su plataforma tecnol\u00f3gica en cualquier momento, sin previa notificaci\u00f3n a los CLIENTES, siempre y cuando sea por razones de mantenimiento de esta, o por razones de orden t\u00e9cnico que se consideren necesarias y convenientes, as\u00ed como en caso de fuerza mayor, caso fortuito o hechos del pr\u00edncipe. Said mechanisms comprise security levels that aim to prevent fraud and protect the CLIENTS, with the custody and proper use of the same remaining under the exclusive responsibility of the CLIENTS and, where applicable, the consequences of their disclosure or use by third parties. For this reason, NETUNO is committed to not issuing or disclosing personal data without the express consent of its CLIENTS, unless required by competent governmental bodies authorized to do so by current national legislation.[\/vc_column_text][vc_column_text]All Intellectual property, including content, software, user interfaces, texts, graphics, logos, designs, photographs, button icons, images, data compilations, and software that are included in the App and\/or delivered to users as part of the service, is the property of NETUNO, its licensors or suppliers, and is protected by applicable laws and regulations governing copyright, trademarks, and other forms of intellectual property.[\/vc_column_text][vc_column_text]It is expressly understood between NETUNO and the CLIENTS that the digital databases, whether original or not, which have been created on the occasion of providing products and services with personal, private, and confidential data and information of the CLIENTS, belong to NETUNO, who is the sole owner of the economic rights over them. Notwithstanding this, NETUNO will protect and respect the rights to privacy, honor, and reputation of individuals, as established in the Constitution of the Bolivarian Republic of Venezuela.[\/vc_column_text][vc_column_text]\n<p style=\"text-align: justify;\">The CLIENTS, in accordance with these Terms and Conditions, must expressly notify NETUNO, through the communication mechanisms established by NETUNO for this purpose, if they do not want to receive informational and\/or advertising messages through the App. In such a case, NETUNO must cease such transmissions and apply the corresponding corrective measures within a period not exceeding twenty-four (24) hours. In this regard, NETUNO, understanding that it must provide its services continuously, regularly, and efficiently, will make its best efforts and proceed to implement the necessary actions to correct any error in its technological platform, guaranteeing the honor and personal and family privacy of the CLIENTS, who acknowledge and accept this.<\/p>\n[\/vc_column_text][vc_column_text]NETUNO reserves the right to suspend access to its technological platform at any time, without prior notification to the CLIENTS, for maintenance reasons, or for technical reasons considered necessary and convenient, as well as in cases of <em>force majeure<\/em>, fortuitous event, or act of state. In these cases, there shall be no type of compensation from NETUNO.[\/vc_column_text][vc_column_text]NETUNO reserves the right to reform these Terms and Conditions, and any change will be published in the App for the purpose of notifying its CLIENTS.[\/vc_column_text][vc_column_text]In the event of any violation of these Terms and Conditions, of the systems that use information technology, of the privacy of individuals and communications, and of the Intellectual Property linked to the technological platform, the provisions of the Special Law against cybercrimes in force in the Bolivarian Republic of Venezuela shall apply.[\/vc_column_text][vc_column_text]The services provided by NETUNO can only be contracted by individuals of legal age, and therefore it will not be responsible for the use of its App by children or adolescents;
